Terms & Conditions for Carol Dunnigan Photography

1. Introduction Welcome to Carol Dunnigan photography. These terms and conditions outline the rules and regulations for the use of our services and website.

2. Services Provided .Carol Dunnigan Photography offers professional photography services including client photography sessions, design consultations, and the delivery of photographic products.

3. Use of Our Services You agree to use our services only for lawful purposes and in a way that does not infringe the rights of others. Prohibited behavior includes harassing or causing distress to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our services.

4. Intellectual Property All content, layout, design, data, and graphics on this website are protected by intellectual property laws and are owned by Carol Dunnigan Photography or its licensors. You agree not to reproduce, republish, download, post, broadcast, or otherwise use Carol Dunnigan Photography content in any way except for your own personal, non-commercial use.

5. Payments and Refunds Payment must be made in full at the time of service unless otherwise agreed upon in advance. All sales are final except where legally required. Refunds and exchanges are granted only at the discretion of Carol Dunnigan Photography. Creative fees and retainers are non-refundable once a session date has been reserved.

6. Cancellation and Rescheduling We understand that life happens. If you need to reschedule your session, please provide at least 48 hours notice. Cancellations made less than 48 hours before your scheduled session may result in forfeiture of our retainer. Carol Dunnigan Photography reserves the right to reschedule sessions due to weather or other circumstances beyond our control.

7. Model Release By booking a session with Carol Dunnigan Photography, you grant Carol Dunnigan Photography permission to use any images captured during your session for marketing, advertising, and promotional purposes including but not limited to website, social media, print materials, and competition entries. If you prefer your images not be used for marketing purposes, please notify us in writing prior to your session.

8. Limitation of Liability Carol Dunnigan Photography will not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of our services. This limitation applies to all claims whether based on warranty, contact, tort, or any other legal theory.

9. Amendments We reserve the right to make changes to these termas and conditions at any time. Your continued use of our services after such changes constitutes acknowledgement and agreement of the amended terms.

10. Governing Law These terms and  conditions are governed by and construed in accordance with the laws of the State of Colorado, and you irrevocably submit to the exclusive jurisdiction of the courts of Colorado.
